refilling, to remedy such defects on reasonable notice; and in the case of failure to remedy such defect, to pay the City a sum equal to the total expense of remedying such defect, plus 25% thereof.
f. To remove all rubbish and surplus earth.
g. To indemnify and hold the City harmless from all damages or claims arising out of the excavation work or accidents caused or claimed by the injured party to have been caused by the excavation or by the failure to do the work or guard it properly, or by any negligence connected with the work of excavating or guarding the excavation.
The Council may add such further restrictions as it deems desirable.
Part Two: Sidewalks
3.20l Specifications. All sidewalks on all streets of the City of Deer River shall be constructed according to the specifications and under the direction of the City Council.
3.202 Snow and ice. Every occupant of property and every owner of unoccupied property fronting a City sidewalk shall keep the sidewalk fronting such property clear of snow and ice. Any owner or occupant who fails to remove snow and ice that may accumulate upon the sidewalk abutting such property within twenty-four hours after having been notified to do so by the Police or City shall be guilty of a petty offense and shall be removed by the City at the owner’s expense.
3.203 Deliveries. No person receiving or delivering goods, wares, or merchandise shall take or keep upon any sidewalk, goods, wares, or merchandise without leaving a clear passageway not less than three feet wide for the use of pedestrians.
Part Three: Tree Line
3.30l Tree Line. There shall be a tree line in and along the public streets and avenues of the City parallel to and half-way between the curb and sidewalk. Any person who shall plant any trees in the streets or avenues of the City except on this line shall be guilty of a misdemeanor.
3.302 Removal of trees planted improperly. Any tree planted in any street or avenue except those which are located on the tree line described in the preceding section shall be removed by the owner or occupant of the adjoining property within 72 hours after notice in writing to do so is given by the Street Commissioner or City Police. If such trees are not removed within the 72 hours specified in the notice, such trees shall be removed by the Street Commissioner or the City Police and the expense thereof may,
