any garbage from any residential premises within this City except a person who has entered into a franchise agreement with the City Council to faithfully and continuously provide certain solid waste collection and disposal service in accordance with the ordinances and regulations of this City and all County ordinances and State statutes, rules and regulations. If deemed advisable, different persons may be granted contracts for solid waste collection in different parts of the City.  In awarding the franchise the City Council shall adopt whatever criteria they deem advisable to protect the health and safety of City residents and business owners.

7.305    Recyclable Material Franchise Agreement.  No person shall, for hire or otherwise, collect or remove any recyclable material in this City except a person who has entered into a franchise agreement with the City Council to faithfully and continuously provide such collection and removal service.  If deemed advisable, different persons may be granted franchise agreements for recyclable material collection in different parts of the City.  In awarding the franchise the City Council shall adopt whatever criteria they deem advisable to protect the health and safety of City residents and business owners.

7.306    Collection - Solid Waste.  Any person or persons granted a franchise for the collection of solid waste within the City of Deer River shall provide such service in accordance with such rules and regulations as may be adopted by the City Council.

7.307    Collection - Recyclable Material.  Any person or persons granted a franchise for the collection of recyclable materials within the City of Deer River shall provide such service in accordance with such rules and regulations as may be adopted by the City Council.

7.308    Exemptions.  All businesses, as defined in Section 7.301, may contract with any party providing a solid waste removal service notwithstanding the grant of a franchise agreement by the City to any party or parties providing residential solid waste removal.  All businesses shall remain strictly liable for the removal of such solid waste pursuant to Section 7.302 of this ordinance, and shall be subject to the penalties contained in Section 7.309 of this ordinance.

7.309    Penalties.  

(1)    Any party providing solid waste pickup at any residence within the City of Deer River without having been granted the franchise for said pickup by the City Council shall be guilty of a misdemeanor.

 (2)    Any party providing recyclable material pickup at any residence within the City of Deer River without having been granted the franchise for said pickup by the City Council shall be guilty of a petty misdemeanor.
